Service Package 5 - Exhibitor Use Forklift Equipment Agreement

Exhibitor Information:

 

  • All forklifts used by exhibitors must be rented through Global Experience Specialists, LLC ("GES"), hereinafter referred to as the "Equipment."
  • Forklifts operated by GES will be available at any time during installation and dismantle of the IWF 2026 show (the "Show"). The Exhibitor Information Manual/Kit/GES Expresso site provides current rates.
  • All forklifts to be rented by an exhibitor must be ordered no later than Monday, July 27, 2026. To qualify for Equipment use, an exhibitor's booth must be 8,000 square feet or more, and must have ordered Service Package #5.
  • The minimum rental is for seven (7) days. These seven days may be split between move-in and move-out. A weekly rental is for seven (7) to nine (9) consecutive days, and may not be split between move-in and move-out.
  • All Equipment will be clearly identified with the exhibiting company's name and designated operator.
  • Current rates for Equipment are as follows:

  • The maximum capacity of Equipment available for Exhibitor Use is 8,000 lb. If specific needs for Equipment of a greater capacity are identified, GES will have a variety of heavier capacity Equipment available to service the customer (see the Exhibitor Information Manual/Kit/Expresso for rates), however, the Exhibitor will not be allowed to operate this Equipment. GES has exclusive rights to operate Equipment with a capacity exceeding 8,000 lbs.
  • Each operator designated by the exhibiting company must be a regular full-time employee of the exhibiting company and must be currently certified in forklift operations and safety. Proof of certification must be provided prior to operating any Equipment, and further upon immediate request, and will be required to be held with the operator at all times.
  • Exhibitor and its employees shall be solely responsible for inspecting the Equipment prior to accepting and using it. The determination as to whether or not the Equipment is suitable for the Exhibitor's purpose is the Exhibitor's alone and GES makes no representations or warranties in regard to the condition of the Equipment or as to its fitness for a particular purpose. Exhibitor agrees that an operator may refuse the Equipment if the operator feels it is unsafe or may create an unsafe or hazardous condition. Exhibitor may accept or reject any or all of the Equipment provided by GES. GES shall have no obligation to provide replacements if Exhibitor rejects any or all of the Equipment. Exhibitor agrees that it is familiar with all OSHA forklift operation regulations and that it will operate all Equipment according to OSHA regulations.
  • In consideration of GES' offer to the Exhibitor for use of the Equipment, Exhibitor does hereby agree to defend, indemnify and hold Global Experience Specialists, LLC, International Woodworking Fair, and Georgia World Congress Center, their respective parents, officers, directors, subsidiaries, employees, subcontractors and agents harmless, from and against any and all actions, costs, claims, losses, expenses and/or damages (including reasonable attorneys' fees), arising out of, or in any way relating to Exhibitor's use or possession of the Equipment and Material. Exhibitor shall further indemnify GES from and against any and all actions, costs, claims, losses, expenses and/or damages (including reasonable attorneys' fees), for or arising out of the bodily injuries to, or the death of any of Exhibitor's employees, GES' employees, or any third parties as a result of Exhibitor's use or possession of the Equipment and Material caused as a result of GES employees taking direction from Exhibitor for the services referenced herein. This indemnity shall survive the expiration or earlier termination of this Release.
  • Exhibitor shall provide GES with a Certificate of Insurance evidencing that Exhibitor maintains Comprehensive General Liability coverage in at least $2,000,000 and Worker's Compensation insurance in statutory amounts. Exhibitor shall provide GES with a Certificate of Insurance naming Global Experience Specialists, LLC, International Woodworking Fair, and Georgia World Congress Center as additional insureds as it relates to the obligations of this indemnity prior to any use of the Equipment. Exhibitor agrees and acknowledges that any failure to provide this certificate prior to any use of the Equipment shall result in GES' refusal to provide the Equipment, and that such refusal shall not result in any breach of this Agreement.
  • All operators must observe all safety rules for the safe operations of forklifts or any other motorized (see attached IWF 2026 Equipment Safe Operations attached hereto). Any unsafe operation, within the sole judgment of any GES personnel, shall result in the immediate termination of this Equipment agreement without recourse to the Exhibitor. GES will have the ability to service the Exhibitor's needs if such termination should occur.
  • All Equipment operations shall be confined to the perimeter of the Exhibitor's booth and is intended for spotting, assembly, or moving of equipment only. No Exhibitor, or any of its agents, at any time will be allowed to off-load or re-load freight or machinery at the dock or at the booth. The Exhibitor shall not under any circumstances perform work for other exhibiting companies, including affiliates that would not otherwise qualify for an Equipment.
  • Monitoring and enforcement of the requirements set forth in this Agreement, including safe operation of the Agreement, will be done by Georgia World Congress Center staff, GES employees and IWF 2026 Floor Managers and staff. Any infractions will be reported to GES. Any Exhibitor found in violation of this Agreement, or found operating Equipment in an unsafe manner, may, without further warning, be disqualified from operating any Equipment. Any further work to be done following disqualification must be performed by GES.
  • The party signing below represents and warrants he/she is authorized to execute this Agreement on behalf of himself/herself, his/her employer and the Exhibitor.
